<p xml:id="par1">To <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Question <choice><abbr>w<hi rend="superscript">t</hi></abbr><expan>what</expan></choice> was <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> <choice><abbr>V. C<hi rend="superscript">rs.</hi></abbr><expan>Vice Chancellors</expan></choice> Oath of Office.  They say <choice><abbr>y<hi rend="superscript">t</hi></abbr><expan>that</expan></choice> <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> words of <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> <lb xml:id="l3"/>Oath are these: <foreign xml:lang="lat">Iurabis quod bene et fideliter præstabis omnia quæ spectant <lb xml:id="l4"/>ad officium Procancellarij hujus Academiæ: Sic te Deus adjuvet &amp;c:</foreign> <choice><abbr>w<hi rend="superscript">ch</hi></abbr><expan>which</expan></choice> office <lb xml:id="l5"/>being stated &amp; prescribed by <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Laws of <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Land &amp; Statutes of <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Vniversity, <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> <lb xml:id="l6"/><choice><abbr>V.C.</abbr><expan>Vice Chancellor</expan></choice> is thereby obliged to observe faithfully those laws so far as they respect <lb xml:id="l7"/>his office: a part of <choice><abbr>w<hi rend="superscript">ch</hi></abbr><expan>which</expan></choice> Statutes were those recited in <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> beginning of the <lb xml:id="l8"/>Answer of <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> <choice><abbr>V.C.</abbr><expan>Vice Chancellor</expan></choice> &amp; Senate formerly presented to y<choice><abbr>o<hi rend="superscript">r</hi></abbr><expan>our</expan></choice> Lordships.  Further <lb xml:id="l9"/><choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> <choice><orig><hi rend="overline">sd</hi></orig><reg>said</reg></choice> Oath we conceive to be as ancient as <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> office of Vicechancellourship, &amp; <lb xml:id="l10"/><choice><abbr>y<hi rend="superscript">t</hi></abbr><expan>that</expan></choice> <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> breaches thereof doe not onely make <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> <choice><abbr>V.C.</abbr><expan>Vice Chancellor</expan></choice> forsworn but also affect <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> <lb xml:id="l11"/>whole Senate.</p>
<p xml:id="par2">To <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Question: Have you never admitted <choice><orig>ꝑ</orig><reg>per</reg></choice>sons to Degrees without <lb xml:id="l12"/>taking <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> oaths.  They answer <choice><abbr>y<hi rend="superscript">t</hi></abbr><expan>that</expan></choice> they know not of any <choice><abbr>y<hi rend="superscript">t</hi></abbr><expan>that</expan></choice> have been so ad<lb type="hyphenated" xml:id="l13"/>mitted, excepting onely such as by <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> custome of <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Vniversity have been <lb xml:id="l14"/>reputed Noblemen.  As to other <choice><orig>ꝑ</orig><reg>per</reg></choice>sons who take Degrees of Learning to use, <lb xml:id="l15"/>exercise, supply or occupy <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> same (as <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> statute words it) they represent <choice><abbr>y<hi rend="superscript">t</hi></abbr><expan>that</expan></choice> <lb xml:id="l16"/>it has been <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> constant custome of <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Vniversity to require <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Oaths.  And for <lb xml:id="l17"/>D<hi rend="superscript">r</hi> Lightfoot in whom your Lordship instanced they are fully satisfied <choice><abbr>y<hi rend="superscript">t</hi></abbr><expan>that</expan></choice> he <lb xml:id="l18"/>did take <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> oaths by reason <choice><abbr>y<hi rend="superscript">t</hi></abbr><expan>that</expan></choice> he subscribed <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> three Articles in their common <lb xml:id="l19"/>Register to <choice><abbr>w<hi rend="superscript">ch</hi></abbr><expan>which</expan></choice> all <choice><orig>ꝑ</orig><reg>per</reg></choice>sons taking <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> oaths do sett their hands, one of <choice><abbr>w<hi rend="superscript">ch</hi></abbr><expan>which</expan></choice> Articles <lb xml:id="l20"/>is <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Kings supremacy, &amp; <choice><abbr>w<hi rend="superscript">ch</hi></abbr><expan>which</expan></choice> subscription is all <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Record they have &amp; conse<supplied reason="damage" cert="high">quently</supplied> <lb xml:id="l21"/>all <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> proofe <choice><abbr>y<hi rend="superscript">t</hi></abbr><expan>that</expan></choice> can be expected from them of any mans taking <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> <choice><orig><hi rend="overline">sd</hi></orig><reg>said</reg></choice> oaths, <supplied reason="damage" cert="high">the</supplied> <pb xml:id="p001v" n="1v"/> oaths themselvs being never recorded.  And yet in proofe of this matter they <lb xml:id="l22"/>further alledge <choice><abbr>y<hi rend="superscript">t</hi></abbr><expan>that</expan></choice> D<hi rend="superscript">r</hi> Lightfoot took his Degree by <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> benefitt of <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> same <lb xml:id="l23"/>Letters from <choice><abbr>w<hi rend="superscript">ch</hi></abbr><expan>which</expan></choice> <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> aforesaid Perrera &amp; Stephens were upon their refusing <lb xml:id="l24"/>to take <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> oaths excluded as appears by <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> records of <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Vniversity.  And if <lb xml:id="l25"/>any one shall represent (as they hear some do) <choice><abbr>y<hi rend="superscript">t</hi></abbr><expan>that</expan></choice> he took a Degree in his <lb xml:id="l26"/>absence from <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Vniversity &amp; consequently without taking <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> <choice><orig><hi rend="overline">sd</hi></orig><reg>said</reg></choice> oaths, <lb xml:id="l27"/>they answer <choice><abbr>y<hi rend="superscript">t</hi></abbr><expan>that</expan></choice> he did it by Proxy under hand &amp; seale in <choice><abbr>w<hi rend="superscript">ch</hi></abbr><expan>which</expan></choice> instrument he <lb xml:id="l28"/>empowers his Proxy to take <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> oaths for him &amp; binds himself to abide by <lb xml:id="l29"/>those oaths according to <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> practise of <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> civil Law.  And further if any <lb xml:id="l30"/>one hath in any hurry of business or otherwise by oversight escaped taking <lb xml:id="l31"/>them, they conceive it was a transgression of <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> law punishable in <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> <choice><orig>ꝑ</orig><reg>per</reg></choice>sons <lb xml:id="l32"/>offending &amp; can be no just precedent for any to transgress them wilfully <lb xml:id="l33"/>&amp; thereby subject themselvs to <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> penalties <unclear reason="copy" cert="high">thereof.</unclear> And they further <lb xml:id="l34"/>say <choice><abbr>y<hi rend="superscript">t</hi></abbr><expan>that</expan></choice> they are fully &amp; particularly assured, <choice><abbr>y<hi rend="superscript">t</hi></abbr><expan>that</expan></choice> no <choice><orig>ꝑ</orig><reg>per</reg></choice>son was ever admitted <lb xml:id="l35"/>to a Degree who refused to take <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> oaths.</p>
<p xml:id="par3">To <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Questions, why <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Senate interposed in this affair &amp; sent up <lb xml:id="l36"/><choice><abbr>Messeng<hi rend="superscript">r</hi>s</abbr><expan>Messengers</expan></choice> to <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> <choice><abbr>V.C.</abbr><expan>Vice Chancellor</expan></choice>.  They answer <choice><abbr>y<hi rend="superscript">t</hi></abbr><expan>that</expan></choice> <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Kings Mandate being communi<lb type="hyphenated" xml:id="l37"/>cated to <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Senate according to its directions they conceived themselvs <lb xml:id="l38"/>obliged by their oaths so to do, for (beside their oaths of Allegiance <lb xml:id="l39"/>&amp; supremacy) all <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Members of <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Senate have obliged themselvs by <lb xml:id="l40"/>their Matriculation Oath to save harmless <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> State, honour &amp; dignity of <lb xml:id="l41"/><choice><sic>of</sic><corr>the</corr></choice> Vniversity as long as they live; &amp; <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> same to defend by their vote <lb xml:id="l42"/>&amp; counsel whether askt or not askt.  And further they represent <choice><abbr>y<hi rend="superscript">t</hi></abbr><expan>that</expan></choice> it <lb xml:id="l43"/>is <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> natural right &amp; priviledge of <unclear reason="copy" cert="high">al Senates</unclear> <choice><abbr>y<hi rend="superscript">t</hi></abbr><expan>that</expan></choice> their members may <lb xml:id="l44"/>consult &amp; advise one another concerning any business <choice><abbr>w<hi rend="superscript">ch</hi></abbr><expan>which</expan></choice> comes before <lb xml:id="l45"/>them, &amp; <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> onely way whereby <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> houses in Senate or any of their <choice><abbr>Mem<hi rend="superscript">rs</hi></abbr><expan>Members</expan></choice> <lb xml:id="l46"/>may consult <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> <choice><abbr>V.C.</abbr><expan>Vice Chancellor</expan></choice> is by Messengers, it being indecent for him to go down <lb xml:id="l47"/>to them, &amp; turbulent for any great Number of them to go up to him.  That <lb xml:id="l48"/>it is very frequent for <choice><orig>ꝑ</orig><reg>per</reg></choice>sons to go up from him to <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> houses to advise <lb xml:id="l49"/>or consult him either in their own Names or in <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> names of many others <lb xml:id="l50"/>or in <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> names of whole Colledges, &amp; by <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> same reason many or all the <lb xml:id="l51"/>Colledges or Senate may consult him by one or more Messengers in any business <pb xml:id="p002r" n="2r"/> <choice><abbr>w<hi rend="superscript">ch</hi></abbr><expan>which</expan></choice> concerns <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> whole.  That his late <choice><abbr>Ma<hi rend="superscript">tie</hi></abbr><expan>Majestie</expan></choice> in a Letter to <del type="strikethrough">his</del> <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Vniversity <lb xml:id="l52"/>dated Decem<choice><orig><hi rend="overline">b</hi></orig><reg>ber</reg></choice> 15<hi rend="superscript">th</hi> 1669 enjoyned <choice><abbr>y<hi rend="superscript">t</hi></abbr><expan>that</expan></choice> none in <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Regent house shall make <lb xml:id="l53"/>any other addresse to <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> <choice><abbr>V.C.</abbr><expan>Vice Chancellor</expan></choice> then by reverent &amp; respectfull applica<choice><abbr><hi rend="overline">con</hi></abbr><expan>tion</expan></choice> <lb xml:id="l54"/>to him: whereby his <choice><orig><hi rend="overline">sd</hi></orig><reg>said</reg></choice> <choice><abbr>Ma<hi rend="superscript">tie</hi></abbr><expan>Majestie</expan></choice> seems both to advise &amp; approve addresses <lb xml:id="l55"/>of this nature; we humbly conceiving <choice><abbr>y<hi rend="superscript">t</hi></abbr><expan>that</expan></choice> <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> sence of both houses was <lb xml:id="l56"/>communicated to <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> <choice><abbr>V.C.</abbr><expan>Vice Chancellor</expan></choice> by their Messengers in <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> most modest quiett <lb xml:id="l57"/>reverent &amp; respectfull manner <choice><abbr>y<hi rend="superscript">t</hi></abbr><expan>that</expan></choice> they could think of.  And <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> reason why <lb xml:id="l58"/>these Messengers rather then others were chosen by <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Senate was because <lb xml:id="l59"/>of their being publick <choice><orig>ꝑ</orig><reg>per</reg></choice>sons or Seniors of their houses.<space dim="vertical" extent="1" unit="lines"/></p>
<p xml:id="par4"><handShift new="#in" scribe="Isaac_Newton"/>They were influenced also by their religion <add place="supralinear" indicator="yes">established &amp; supported by <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> laws they are commanded to infringe</add>.  Men of <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Roman ffaith <lb xml:id="l60"/>have been put into Masterships of Colleges. <p xml:id="par6">To <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Question, Did you ever know <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Kings Mandate for Degrees declined <lb xml:id="l81"/>before They answer always in this case where <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> oaths have been refused.  <lb xml:id="l82"/>An instance of this was given in one Tatnel who was a non-conformist and <lb xml:id="l83"/>upon certificate from <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Vniversity <choice><abbr>y<hi rend="superscript">t</hi></abbr><expan>that</expan></choice> he refused to take <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> <choice><orig><hi rend="overline">sd</hi></orig><reg>said</reg></choice> oaths his <lb xml:id="l84"/>late <choice><abbr>Ma<hi rend="superscript">tie</hi></abbr><expan>Majestie</expan></choice> was pleased to recall his particular Mandate for conferring <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> <lb xml:id="l85"/>Degree of D<hi rend="superscript">r</hi> of Divinity.  And they further say <choice><abbr>y<hi rend="superscript">t</hi></abbr><expan>that</expan></choice> M<hi rend="superscript">r.</hi> Pereira &amp; M<hi rend="superscript">r</hi> Stephens <lb xml:id="l86"/>Servants to her <choice><abbr>Ma<hi rend="superscript">ty</hi></abbr><expan>Majesty</expan></choice> <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Queen Dowager &amp; Roman Catholicks, upon his <lb xml:id="l87"/>late <choice><abbr>Ma<hi rend="superscript">ts</hi></abbr><expan>Majestys</expan></choice> general Mandate for conferring Degrees on occasion of the <lb xml:id="l88"/>Kings comming to <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Vniversity had their graces passed by <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Senate but <lb xml:id="l89"/>upon their refusing to take these oaths were not admitted.</p>
<p xml:id="par7">To <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Question have you never admitted <choice><orig>ꝑ</orig><reg>per</reg></choice>sons to Degrees without taking <lb xml:id="l90"/><choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> oaths: They answer <choice><abbr>y<hi rend="superscript">t</hi></abbr><expan>that</expan></choice> they know not of any <choice><abbr>y<hi rend="superscript">t</hi></abbr><expan>that</expan></choice> have been so admitted, <lb xml:id="l91"/>excepting onely such as by <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Custome of <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> <choice><abbr>Vniv:</abbr><expan>Vniversity</expan></choice> have been reputed Noblemen.  <lb xml:id="l92"/>As to other <choice><orig>ꝑ</orig><reg>per</reg></choice>sons who take Degrees of Learning to use exercise supply or <lb xml:id="l93"/>occupy <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> same (as <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> statute words it) they re<choice><abbr>p<hi rend="superscript">r</hi></abbr><expan>pre</expan></choice>sent <choice><abbr>y<hi rend="superscript">t</hi></abbr><expan>that</expan></choice> it has been <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> constant <lb xml:id="l94"/>custome of <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> <choice><abbr>Vniv:</abbr><expan>Vniversity</expan></choice> to require <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> oaths. And yet in proofe of this Matter they further alledge <lb xml:id="l101"/><choice><abbr>y<hi rend="superscript">t</hi></abbr><expan>that</expan></choice> D<hi rend="superscript">r</hi> Lightfoot took his Degree by <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> benefitt of <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> same Letters from <choice><abbr>w<hi rend="superscript">ch</hi></abbr><expan>which</expan></choice> the <lb xml:id="l102"/>afore<choice><orig><hi rend="overline">sd</hi></orig><reg>said</reg></choice> Pereira &amp; Stephens were upon their refusing to take <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> oaths excluded <pb xml:id="p003v" n="3v"/> as appears by <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Records of <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Vniv<add place="inline" indicator="no" hand="#in">ersity.</add>  And if any one shall re<choice><abbr>p<hi rend="superscript">r</hi></abbr><expan>pre</expan></choice>sent (as they hear <lb xml:id="l103"/>some do) <choice><abbr>y<hi rend="superscript">t</hi></abbr><expan>that</expan></choice> he took a Degree in his absence from <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> <choice><abbr>Vniv:</abbr><expan>Vniversity</expan></choice> &amp; consequently <lb xml:id="l104"/>without taking <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> <choice><orig><hi rend="overline">sd</hi></orig><reg>said</reg></choice> oaths, they answer <choice><abbr>y<hi rend="superscript">t</hi></abbr><expan>that</expan></choice> he did it by Proxy under hand &amp; <lb xml:id="l105"/>Seale in <choice><abbr>w<hi rend="superscript">ch</hi></abbr><expan>which</expan></choice> instrument he empowers his Proxy to take <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> oaths for him and <lb xml:id="l106"/>binds himself to abide by those oaths, according to <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> practise of <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> civil Law.  <lb xml:id="l107"/>And further if any one hath in any hurry of business or otherwise by oversight <lb xml:id="l108"/>escaped taking them, they conceive it was a transgression of <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Law punishable <lb xml:id="l109"/>in <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> <choice><orig>ꝑ</orig><reg>per</reg></choice>sons offending &amp; can be no just precedent for any to transgress them <lb xml:id="l110"/>wilfully &amp; thereby subject themselvs to <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> penalties thereof. <p xml:id="par10">To <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Question, Did you ever know <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Kings Mandate for Degrees <lb xml:id="l157"/>declined before. They answer always in this Case where <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> oaths have been <lb xml:id="l158"/>refused.  An instance of this was given in one Tatnel who was a Non-<lb xml:id="l159"/>conformist and upon certificate from <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Vniversity <choice><abbr>y<hi rend="superscript">t</hi></abbr><expan>that</expan></choice> he refused to take <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> <lb xml:id="l160"/><choice><orig><hi rend="overline">sd</hi></orig><reg>said</reg></choice> oaths his <lb xml:id="l161"/>late <choice><abbr>Ma<hi rend="superscript">tie</hi></abbr><expan>Majestie</expan></choice> was pleased to recall his particular Mandate for <lb xml:id="l162"/>conferring <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Degree of D<hi rend="superscript">r</hi> of Divinity.  And they further say <choice><abbr>y<hi rend="superscript">t</hi></abbr><expan>that</expan></choice> M<hi rend="superscript">r.</hi> <lb xml:id="l163"/>Pereira &amp; M<hi rend="superscript">r</hi> Stephens Servants to her <choice><abbr>Ma<hi rend="superscript">ty</hi></abbr><expan>Majesty</expan></choice> <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Queen Dowager &amp; Roman <lb xml:id="l164"/>Catholicks, upon his <lb xml:id="l165"/>late <choice><abbr>Ma<hi rend="superscript">ts</hi></abbr><expan>Majestys</expan></choice> general Mandate for conferring <del type="cancelled">of</del> Degrees <lb xml:id="l166"/>on occasion of <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Kings coming to <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> <choice><abbr>Vniv:</abbr><expan>Vniversity</expan></choice> had their graces passed by <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> <lb xml:id="l167"/>Senate but upon their refusing to take these Oaths were not admitted.</p>
<p xml:id="par11">To <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Question have you never admitted persons to Degrees without <lb xml:id="l168"/>taking <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Oaths. They answer <choice><abbr>y<hi rend="superscript">t</hi></abbr><expan>that</expan></choice> they know not of any <choice><abbr>y<hi rend="superscript">t</hi></abbr><expan>that</expan></choice> have been so <lb xml:id="l169"/>admitted, excepting onely such as by <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Custome of <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Vniversity have <lb xml:id="l170"/>been reputed Noblemen.  As to other <choice><orig>ꝑ</orig><reg>per</reg></choice>sons who take Degrees of Learning <lb xml:id="l171"/>to use exercise supply or occupy <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> same (as <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Statute words it) they re<lb type="hyphenated" xml:id="l172"/>present <choice><abbr>y<hi rend="superscript">t</hi></abbr><expan>that</expan></choice> it has been <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> constant <lb xml:id="l173"/>Custome of <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> <choice><abbr>Vniv:</abbr><expan>Vniversity</expan></choice> to require <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Oaths.  <lb xml:id="l174"/>And for D<hi rend="superscript">r.</hi> Lightfoot in whom his Lordship instanced they are fully sa<lb type="hyphenated" xml:id="l175"/>tisfied <choice><abbr>y<hi rend="superscript">t</hi></abbr><expan>that</expan></choice> he did take <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> oaths by reason <choice><abbr>y<hi rend="superscript">t</hi></abbr><expan>that</expan></choice> he subscribed <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> three Articles <lb xml:id="l176"/>in their co<choice><orig>m̄</orig><reg>mm</reg></choice>on Register to <choice><abbr>w<hi rend="superscript">ch</hi></abbr><expan>which</expan></choice> all <choice><orig>ꝑ</orig><reg>per</reg></choice>sons taking <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> oaths do sett their hands, <lb xml:id="l177"/>one of <choice><abbr>w<hi rend="superscript">ch</hi></abbr><expan>which</expan></choice> Articles is <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Kings Supremacy, &amp; <choice><abbr>w<hi rend="superscript">ch</hi></abbr><expan>which</expan></choice> subscription is all <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Record <pb xml:id="p005v" n="5v"/> they have, &amp; consequently all <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> proofe <choice><abbr>y<hi rend="superscript">t</hi></abbr><expan>that</expan></choice> can be expected from them of <lb xml:id="l178"/>any mans taking <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> <choice><orig><hi rend="overline">sd</hi></orig><reg>said</reg></choice> oaths, <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> oaths themselvs being never recorded.  <lb xml:id="l179"/>And yet in proof of this Matter they further alledge <choice><abbr>y<hi rend="superscript">t</hi></abbr><expan>that</expan></choice> D<hi rend="superscript">r.</hi> Lightfoot <lb xml:id="l180"/>took his Degree by <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> benefitt of <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> same Letters from <choice><abbr>w<hi rend="superscript">ch</hi></abbr><expan>which</expan></choice> the afore<choice><orig><hi rend="overline">sd</hi></orig><reg>said</reg></choice> <lb xml:id="l181"/>Pereira &amp; Stephens were upon their refusing to take <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> oaths excluded <lb xml:id="l182"/>as appears by <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> records of <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Vniversity.  And if any one shall re<choice><abbr>p<hi rend="superscript">r</hi></abbr><expan>pre</expan></choice>sent <lb xml:id="l183"/>(as they hear some do) <choice><abbr>y<hi rend="superscript">t</hi></abbr><expan>that</expan></choice> he took a Degree in his absence from <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> <lb xml:id="l184"/><choice><abbr>Vniv:</abbr><expan>Vniversity</expan></choice> &amp; consequently <choice><abbr>w<hi rend="superscript">th</hi></abbr><expan>with</expan></choice>out taking <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> <choice><orig><hi rend="overline">sd</hi></orig><reg>said</reg></choice> oaths, they answer <choice><abbr>y<hi rend="superscript">t</hi></abbr><expan>that</expan></choice> he did <lb xml:id="l185"/>it by Proxy under hand &amp; Seal, in <choice><abbr>w<hi rend="superscript">ch</hi></abbr><expan>which</expan></choice> instrument he empowers his <lb xml:id="l186"/>Proxy to take <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> oaths for him and binds himself to abide by those oaths, <lb xml:id="l187"/>according to <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> practise of <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> civil Law.  And further if any one hath <lb xml:id="l188"/>in any hurry of business or otherwise by oversight escaped taking them, <lb xml:id="l189"/>they conceive it was a transgression of <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Law punishable in <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> <choice><orig>ꝑ</orig><reg>per</reg></choice>sons <lb xml:id="l190"/>offending, &amp; can be no just precedent for any to transgress them wil<lb xml:id="l191"/>fully &amp; thereby subject themselvs to <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> penalties thereof. And they <lb xml:id="l192"/>further say <choice><abbr>y<hi rend="superscript">t</hi></abbr><expan>that</expan></choice> they are fully &amp; particularly assured <choice><abbr>y<hi rend="superscript">t</hi></abbr><expan>that</expan></choice> no <choice><orig>ꝑ</orig><reg>per</reg></choice>son was <lb xml:id="l193"/>ever admitted to a Degree who refused to take <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> oaths.</p>
<p xml:id="par12">To <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Question why <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Senate interposed in this affair &amp; sent up <lb xml:id="l194"/>Messengers to <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> <choice><abbr>V.C</abbr><expan>Vice Chancellor</expan></choice>.  They answer <choice><abbr>y<hi rend="superscript">t</hi></abbr><expan>that</expan></choice> <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Kings Mandate being communicated <lb xml:id="l195"/>to <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Senate according to its direction, <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> accepting <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> same would <lb xml:id="l196"/>have passed for their act: especially since Degrees are not given by <lb xml:id="l197"/><choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> <choice><abbr>V.C.</abbr><expan>Vice Chancellor</expan></choice> without <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> senate consisting of a certain number of <choice><orig>ꝑ</orig><reg>per</reg></choice>sons <lb xml:id="l198"/>at <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> least &amp; consenting either by vote or else by silence <choice><abbr>w<hi rend="superscript">ch</hi></abbr><expan>which</expan></choice> in their <lb xml:id="l199"/>proceedings usually passeth for an affirmative vote.  They conceived <lb xml:id="l200"/>themselvs obliged <unclear reason="copy" cert="low">also</unclear> by their <add place="supralinear" indicator="yes">oaths</add> to interpose. And further <lb xml:id="l211"/>they represent <choice><abbr>y<hi rend="superscript">t</hi></abbr><expan>that</expan></choice> it is <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> natural right &amp; priviledge of all Senates <lb xml:id="l212"/><choice><abbr>y<hi rend="superscript">t</hi></abbr><expan>that</expan></choice> their members may consult &amp; advise one another concerning any <lb xml:id="l213"/>business <choice><abbr>w<hi rend="superscript">ch</hi></abbr><expan>which</expan></choice> comes before them, &amp; <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> onely way whereby <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> houses in <lb xml:id="l214"/>Senate or any of their members may conveniently consult <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> <choice><abbr>V.C.</abbr><expan>Vice Chancellor</expan></choice> is <lb xml:id="l215"/>by Messengers it being indecent for him to go down to them, &amp; turbulent <lb xml:id="l216"/>for any great Number of them to go up to him. That <lb xml:id="l310"/>it is very frequent for <choice><orig>ꝑ</orig><reg>per</reg></choice>sons to go up to him from <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> houses to advise or consult <lb xml:id="l311"/>him, either in their own Names or in <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Names of many others, or in <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Names <lb xml:id="l312"/>of whole Colledges, &amp; by <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> same reason, <del type="cancelled">many or</del> all <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Colledges, or Senate <lb xml:id="l313"/>may consult him, by one or <lb xml:id="l314"/>more <choice><abbr>Messeng<hi rend="superscript">rs</hi></abbr><expan>Messengers</expan></choice>, in any business <choice><abbr>w<hi rend="superscript">ch</hi></abbr><expan>which</expan></choice> concerns <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> whole. <pb xml:id="p008r" n="8r"/> 
That it would be a force upon <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Senate to be required <add place="supralinear" indicator="yes" hand="#unknown">to be</add> <choice><abbr>p<hi rend="superscript">r</hi></abbr><expan>pre</expan></choice>sent at an act which <lb xml:id="l315"/>cannot be done without them, &amp; to have <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> thing communicated to them, <lb xml:id="l316"/>in order to its being done, &amp; yet, whilst they are averse from it, to be denyed <lb xml:id="l317"/>all liberty of signifying their dissent.  That a Grace is not <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> proper way of <lb xml:id="l318"/><choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Senate's signifying their dissent from <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> <choice><abbr>V.C.</abbr><expan>Vice Chancellor</expan></choice> in an illegal Act; for Graces <lb xml:id="l319"/>are proposed by private <choice><orig>ꝑ</orig><reg>per</reg></choice>sons to <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> <choice><abbr>V.C.</abbr><expan>Vice Chancellor</expan></choice> to be communicated to <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Senate, &amp; <lb xml:id="l320"/>may be laid aside by him, or stop't by any one in <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> <del type="over">h</del><add place="over" indicator="no">H</add>ead. As to other <choice><orig>ꝑ</orig><reg>per</reg></choice>sons who take Degrees of Learning to <lb xml:id="l355"/>use exercise supply or occupy <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> same (as <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> statute words it) they re<lb type="hyphenated" xml:id="l356"/>present <choice><abbr>y<hi rend="superscript">t</hi></abbr><expan>that</expan></choice> it has been <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> <del type="cancelled">Custome</del> constant Custome of <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Vniversity to <lb xml:id="l357"/>require <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Oaths.  And for <lb xml:id="l358"/>D<hi rend="superscript">r</hi> Lightfoot in whom y<choice><abbr>o<hi rend="superscript">r</hi></abbr><expan>our</expan></choice> Lordship instanced <lb xml:id="l359"/>they are fully satisfied <choice><abbr>y<hi rend="superscript">t</hi></abbr><expan>that</expan></choice> he did take <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Oaths by reason <choice><abbr>y<hi rend="superscript">t</hi></abbr><expan>that</expan></choice> he subscribed <lb xml:id="l360"/><choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> three Articles in their co<choice><orig>m̄</orig><reg>mm</reg></choice>on Register to <choice><abbr>w<hi rend="superscript">ch</hi></abbr><expan>which</expan></choice> all <choice><orig>ꝑ</orig><reg>per</reg></choice>sons taking <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> <lb xml:id="l361"/>Oaths do sett their hands, one of <choice><abbr>w<hi rend="superscript">ch</hi></abbr><expan>which</expan></choice> Articles is <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Kings supremacy, and <lb xml:id="l362"/><choice><abbr>w<hi rend="superscript">ch</hi></abbr><expan>which</expan></choice> subscription is all <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Record they have &amp; consequently all <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> proofe <choice><abbr>y<hi rend="superscript">t</hi></abbr><expan>that</expan></choice> <lb xml:id="l363"/>can be expected from them of any mans taking <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> <choice><orig><hi rend="overline">sd</hi></orig><reg>said</reg></choice> Oaths, <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Oaths them<lb type="hyphenated" xml:id="l364"/>selves being never recorded.  And yet in proofe of this Matter they further <lb xml:id="l365"/>alledge <choice><abbr>y<hi rend="superscript">t</hi></abbr><expan>that</expan></choice> D<hi rend="superscript">r</hi> Lightfoot took his Degree by <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> benefitt of <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> same Letters <lb xml:id="l366"/>from <choice><abbr>w<hi rend="superscript">ch</hi></abbr><expan>which</expan></choice> <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> aforesaid Perrera &amp; Stephens were upon their refusing to take <lb xml:id="l367"/><choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Oaths excluded as appears by <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Records of <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Vniversity.  And if any <lb xml:id="l368"/>one shall represent (as they hear some doe) <choice><abbr>y<hi rend="superscript">t</hi></abbr><expan>that</expan></choice> he took a Degree in his <lb xml:id="l369"/>absence from <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Vniversity &amp; consequently without taking <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> <choice><orig><hi rend="overline">sd</hi></orig><reg>said</reg></choice> Oaths; they <lb xml:id="l370"/>answer <choice><abbr>y<hi rend="superscript">t</hi></abbr><expan>that</expan></choice> he did it by Proxy under hand &amp; Seale in <choice><abbr>w<hi rend="superscript">ch</hi></abbr><expan>which</expan></choice> instrument he em<lb type="hyphenated" xml:id="l371"/>powers his Proxy to take <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Oaths for him and binds himself to abide by those <lb xml:id="l372"/>Oaths, according to <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> practise of <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> civil Law.  And further if any one hath <lb xml:id="l373"/>in any hurry of business or otherwise by oversight escaped taking them, <lb xml:id="l374"/>they conceive it was a transgression of <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Law punishable in <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> <choice><orig>ꝑ</orig><reg>per</reg></choice>sons offending <pb xml:id="p008v" n="8v"/> &amp; can be no just precedent for any to transgress them willfully &amp; thereby subject <lb xml:id="l375"/>themselvs to <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> penalties thereof. And they further say <choice><abbr>y<hi rend="superscript">t</hi></abbr><expan>that</expan></choice> they are fully &amp; parti<lb type="hyphenated" xml:id="l376"/>cularly assured, <choice><abbr>y<hi rend="superscript">t</hi></abbr><expan>that</expan></choice> noe <choice><orig>ꝑ</orig><reg>per</reg></choice>son was ever admitted to a Degree who refused to <lb xml:id="l377"/>take <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Oaths.</p>
<p xml:id="par19">To <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Questions why <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Senate interposed in this affair &amp; sent up Mes<lb type="hyphenated" xml:id="l378"/>sengers to <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Vice<choice><abbr>Chancell<hi rend="superscript">r</hi></abbr><expan>Chancellor</expan></choice>.  They answer <choice><abbr>y<hi rend="superscript">t</hi></abbr><expan>that</expan></choice> <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Kings Mandate being com<lb type="hyphenated" xml:id="l379"/>municated to <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Senate according to its direction<del type="cancelled">s</del> they conceived themselvs <lb xml:id="l380"/>obliged by their Oaths so to doe, for (besides their Oaths of Allegiance &amp; <lb xml:id="l381"/>Supremacy) all <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Members of <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Senate have obliged themselvs by their <lb xml:id="l382"/>Matriculation Oaths <add place="supralinear" indicator="yes" hand="#in">to preserve the privileges of <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Vniversity as much as in them lies, &amp;</add> to save harmless <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> State, honour &amp; dignity of <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> <lb xml:id="l383"/>Vniversity as long as they live, &amp; the same to defend by their vote and <lb xml:id="l384"/>Counsell whether askt or not askt. And further they re<choice><abbr>p<hi rend="superscript">r</hi></abbr><expan>pre</expan></choice>sent <choice><abbr>y<hi rend="superscript">t</hi></abbr><expan>that</expan></choice> it is <lb xml:id="l385"/><choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> naturall right &amp; priviledge of all Senates <choice><abbr>y<hi rend="superscript">t</hi></abbr><expan>that</expan></choice> their Members may con<lb xml:id="l386"/>sult &amp; advise one another concerning any business <choice><abbr>w<hi rend="superscript">ch</hi></abbr><expan>which</expan></choice> comes before them, <lb xml:id="l387"/>&amp; <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> onely way whereby <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> houses in Senate or any of their Members may <lb xml:id="l388"/>consult <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> <choice><abbr>Vicechancell<hi rend="superscript">r</hi></abbr><expan>Vicechancellor</expan></choice> is by Messengers, it being indecent for him to goe <lb xml:id="l389"/>down to them, &amp; turbulent for any great Number of them to go up to <lb xml:id="l390"/>him.  That it is very frequent for <choice><orig>ꝑ</orig><reg>per</reg></choice>sons to go up from him to <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> houses to <lb xml:id="l391"/>advise or consult him either in their own Names or in <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Names of many <lb xml:id="l392"/>others or in <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Names of whole Colledges, &amp; by <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> same reason many <lb xml:id="l393"/>or all <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Colledges or Senate may consult him by one or more <choice><abbr>Messeng<hi rend="superscript">rs</hi></abbr><expan>Messengers</expan></choice> <lb xml:id="l394"/>in any business <choice><abbr>w<hi rend="superscript">ch</hi></abbr><expan>which</expan></choice> concerns <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> whole.  That his late <choice><abbr>Ma<hi rend="superscript">tie</hi></abbr><expan>Majestie</expan></choice> in a Letter to <lb xml:id="l395"/><choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Vniversity dated Decemb. 15<hi rend="superscript">th</hi> 1669 enjoyned <choice><abbr>y<hi rend="superscript">t</hi></abbr><expan>that</expan></choice> none in <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Regent house <lb xml:id="l396"/>shall make any other address to <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Vice <choice><abbr>ch:</abbr><expan>chancellor</expan></choice> then by reverent &amp; respect<lb type="hyphenated" xml:id="l397"/>full application to him: whereby his <choice><orig><hi rend="overline">sd</hi></orig><reg>said</reg></choice> <choice><abbr>Ma<hi rend="superscript">tie</hi></abbr><expan>Majestie</expan></choice> seems both to advise &amp; <lb xml:id="l398"/>approve addresses of this nature; we humbly conceiving <choice><abbr>y<hi rend="superscript">t</hi></abbr><expan>that</expan></choice> <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> sense of <lb xml:id="l399"/>both houses was communicated to <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> <choice><abbr>V.C.</abbr><expan>Vice Chancellor</expan></choice> by their <choice><abbr>Messeng<hi rend="superscript">rs</hi></abbr><expan>Messengers</expan></choice> in <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> most <lb xml:id="l400"/>modest quiet reverent &amp; respectfull manner <choice><abbr>y<hi rend="superscript">t</hi></abbr><expan>that</expan></choice> they could think of.  And <lb xml:id="l401"/><choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> reason why these Messengers rather then others were chosen by <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Senate <lb xml:id="l402"/>was because of their being publick <choice><orig>ꝑ</orig><reg>per</reg></choice>sons or Seniors of their houses.</p>
