<p xml:id="par10">Queen Eliz. in 29<hi rend="superscript">th</hi> yeare of her Reign erects a new office in <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Common pleas, for <lb xml:id="l29"/><choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> making of Supersedeas or exigents, <choice><abbr>y<hi rend="superscript">t</hi></abbr><expan>that</expan></choice> issue there, she grants it to Richard Cavendish <lb xml:id="l30"/>her servant, sends to have him admitted, but <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Iudges delay the doing of it for this <lb xml:id="l31"/>reason, because Protonotaries, &amp; Philizers, claimed <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> making of those writs. <p xml:id="par11">This was not to take their Right, but to put them to their Action.</p>

This Act was repealed by 1 &amp; 2 <lb xml:id="l48"/>Phil &amp; Mar sess. 2 c 8. <p rend="indent15" xml:id="par16">According to your <choice><abbr>L<hi rend="superscript">d</hi></abbr><expan>Lord</expan></choice>ships order made in his <choice><abbr>Ma<hi rend="superscript">ties</hi></abbr><expan>Majesties</expan></choice> <lb xml:id="l72"/>Court of star-chamber <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> 12<hi rend="superscript">t</hi> of May last, we have taken considera<lb xml:id="l73"/>tion of <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> particulars wherein <choice><abbr>o<hi rend="superscript">r</hi></abbr><expan>our</expan></choice> opinions are required by <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> said order &amp; <lb xml:id="l74"/>we have all agreed:</p>
<p xml:id="par17">That processes may issue out of <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Ecclesiastical Courts, &amp; <choice><abbr>y<hi rend="superscript">t</hi></abbr><expan>that</expan></choice> a Patent <lb xml:id="l75"/>under <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> great seal is not necessary for <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> keeping of <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> said Ecclesiastical <lb xml:id="l76"/>Courts or for <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> enabling of Citations, Suspensions, Excommunications or <lb xml:id="l77"/>other Censures of <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Church; &amp; <choice><abbr>y<hi rend="superscript">t</hi></abbr><expan>that</expan></choice> it is not necessary that summons, <lb xml:id="l78"/>Citations or other Processes Ecclesiastical in <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> said Courts or Institutions, <lb xml:id="l79"/>or Inductions to Benefices or correction of Ecclesiastical offences by censure <lb xml:id="l80"/>in those Courts be in the name or <choice><abbr>w<hi rend="superscript">th</hi></abbr><expan>with</expan></choice> <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> stile of <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> king or under <lb xml:id="l81"/>the kings seal, or that their seals of office have in them the kings <lb xml:id="l82"/>Arms.  And <choice><abbr>y<hi rend="superscript">t</hi></abbr><expan>that</expan></choice> <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> statute of primo Edwardi sexti c. 2 <choice><abbr>w<hi rend="superscript">ch</hi></abbr><expan>which</expan></choice> enacted <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> <lb xml:id="l83"/>contrary is not now in force.</p>

<p xml:id="par19">His <choice><abbr>Ma<hi rend="superscript">ties</hi></abbr><expan>Majesties</expan></choice> promise is no argu<choice><abbr>m<hi rend="superscript">t</hi></abbr><expan>ment</expan></choice> <del type="cancelled">why we</del> for abrogating <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> laws because he <lb xml:id="l84"/>is but for his life these for ever, that null &amp; void by its being contrary <lb xml:id="l85"/>to his religion, these firm &amp; binding, that <choice><abbr>w<hi rend="superscript">th</hi></abbr><expan>with</expan></choice>out a legal penalty upon those <lb xml:id="l86"/><del type="cancelled"><unclear reason="del" cert="medium">men</unclear></del> <add place="supralinear" indicator="no">subjects who</add> may act contrary to it, these enforced <del type="cancelled"><unclear reason="del" cert="medium">given</unclear> to all sub</del> by <add place="supralinear" indicator="yes">appointed</add> penalties <lb xml:id="l87"/>Nor is it more loyall more honest or more prudent to take away the <lb xml:id="l88"/>laws for <choice><abbr>o<hi rend="superscript">r</hi></abbr><expan>our</expan></choice> religion in trusting to a bare promise to maintain it <choice><abbr>w<hi rend="superscript">th</hi></abbr><expan>with</expan></choice>out them <lb xml:id="l89"/>then it would be to <del type="cancelled"><unclear reason="del" cert="medium">pretend</unclear></del> throw up <add place="supralinear" indicator="yes">all</add> <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> laws for liberty &amp; property should <lb xml:id="l90"/>the king desire it &amp; promise to maintain <del type="cancelled"><gap reason="illgblDel" extent="1" unit="words"/></del> the people in all their <lb xml:id="l91"/>rights without them.  <del type="cancelled"><gap reason="illgblDel" extent="1" unit="words"/></del> If we are for <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> first case more then wee <lb xml:id="l92"/>should be for <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> last tis <del type="cancelled"><gap reason="illgblDel" extent="1" unit="words"/></del> becaus we have less zeale for <add place="supralinear" indicator="yes"><choice><abbr>o<hi rend="superscript">r</hi></abbr><expan>our</expan></choice></add> God &amp; <lb xml:id="l93"/>religion then for <del type="cancelled">liberty &amp; property</del> <choice><abbr>o<hi rend="superscript">r</hi></abbr><expan>our</expan></choice> civil rights.  An Attorney who <lb xml:id="l94"/>should deliver up his Clients bond upon a bare promise <del type="cancelled"><gap reason="illgblDel" extent="1" unit="chars"/></del> of the money <lb xml:id="l95"/>would in <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> opinion of all men be fals to his trust &amp; this is <choice><abbr>o<hi rend="superscript">r</hi></abbr><expan>our</expan></choice> case <lb xml:id="l96"/>The people have entrusted us <choice><abbr>w<hi rend="superscript">th</hi></abbr><expan>with</expan></choice> <choice><abbr>o<hi rend="superscript">r</hi></abbr><expan>our</expan></choice> rights &amp; we ought not to de<lb xml:id="l97"/>liver up their security upon any promise whatsoever.  Nor will <choice><abbr>o<hi rend="superscript">r</hi></abbr><expan>our</expan></choice> faith <lb xml:id="l98"/>&amp; trust in <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> kings integrity excuse us any more then the Attorneys con<lb xml:id="l99"/>fidence in <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> creditor could be an excuse for him.  But (<choice><abbr>w<hi rend="superscript">ch</hi></abbr><expan>which</expan></choice> is wors) <lb xml:id="l100"/>in abrogating <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> penal laws &amp; tests we shall absolve <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> king fom <lb xml:id="l101"/>his promise of maintaining <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Church of England according to law, &amp; <lb xml:id="l102"/>so have neither law nor <del type="cancelled">rel</del> promise left for <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> support of <choice><abbr>o<hi rend="superscript">r</hi></abbr><expan>our</expan></choice> religion.  <lb xml:id="l103"/>And in taking away these laws we may revive severall old laws &amp; customes <lb xml:id="l104"/>&amp; interpretations of laws against <choice><abbr>o<hi rend="superscript">r</hi></abbr><expan>our</expan></choice> selves, such as are <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> 1<hi rend="superscript">st</hi> <del type="strikethrough">chap</del> <add place="supralinear" indicator="no"><choice><abbr>sect.</abbr><expan>section</expan></choice></add> <lb xml:id="l105"/>of Magna charta for preserving <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> popish church of <choice><abbr>Engl.</abbr><expan>England</expan></choice> the three <del type="over">a</del><add place="over" indicator="no">A</add>cts <choice><abbr>ag<hi rend="superscript">t</hi></abbr><expan>against</expan></choice> Lollards &amp; others whom <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Roman Church accounts hereticks <lb xml:id="l106"/>repealed by <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Act primo Elizab. the commission of <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Sheriffs still directed <lb xml:id="l107"/>to them for prosecuting those Lollards &amp; hereticks, the writt <foreign xml:lang="lat">de excommuni<lb xml:id="l108"/>cato capiendo</foreign>. We shall also make <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Ecclesiastical court more formida<lb xml:id="l109"/>ble by taking away <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> laws <choice><abbr>w<hi rend="superscript">ch</hi></abbr><expan>which</expan></choice> restrain it.</p>

I know not whether some here have <add place="supralinear" indicator="yes">unadvisedly</add> promised <lb xml:id="l119"/>any thing <del type="strikethrough">in these matters, I would re</del> contrary to <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> intent of his <lb xml:id="l120"/>oaths, I would remind him that <del type="cancelled">his oa</del> such promises are not binding.</p>

<p xml:id="par21">To comprise in an Act for <choice><abbr>lib<hi rend="superscript">ty</hi></abbr><expan>liberty</expan></choice> of <choice><abbr>Consc.</abbr><expan>Conscience</expan></choice> what relates to <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> freedom <lb xml:id="l121"/>&amp; in another Act, <choice><abbr>w<hi rend="superscript">t</hi></abbr><expan>what</expan></choice> relates to <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Government.</p>
<p xml:id="par22">To settle every thing by severe penalties.</p>
<p xml:id="par23">To describe <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Church of England not by <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> name of <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Church of Eng<lb xml:id="l122"/>land but by <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> circumstances of her doctrine in opposition to popery.  ffor <lb xml:id="l123"/>the same <choice><abbr>Ch.</abbr><expan>Church</expan></choice> of <choice><abbr>E.</abbr><expan>England</expan></choice> may by succesive reformations be in one age of one <lb xml:id="l124"/><choice><abbr>relig.</abbr><expan>religion</expan></choice> in another of another.</p>
<p xml:id="par24">To make a previous Act for securing <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> legal election of Parlia<choice><abbr>m<hi rend="superscript">ts</hi></abbr><expan>ments</expan></choice> <lb xml:id="l125"/>least there be the same means used for getting of these <del type="cancelled"><gap reason="illgblDel" extent="1" unit="words"/></del> Acts as <lb xml:id="l126"/>has been now for getting off <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> former.</p>
<p xml:id="par25">In <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Act for liberty to confirm the repeal of all ancient laws made in <lb xml:id="l127"/>favour of Popery, to <del type="cancelled">int</del> review &amp; interpret <add place="supralinear" indicator="yes">most plainly</add> <choice><abbr>y<hi rend="superscript">t</hi></abbr><expan>that</expan></choice> 1<hi rend="superscript">st</hi> <choice><abbr>ch.</abbr><expan>chapter</expan></choice> of <choice><abbr>M.</abbr><expan>Magna</expan></choice> Charta &amp; of <lb xml:id="l128"/>all other <add place="supralinear" indicator="yes">ancient</add> laws in force about religion least they be hereafter interpreted in <lb xml:id="l129"/>favour of Popery by <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Iudges.</p>
<p xml:id="par26">To secure the interpretation of this law to a perpetuall commission of <lb xml:id="l130"/>12 Lawyers, 4 to be chosen by <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> King 4 by <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> House of <choice><abbr>L<hi rend="superscript">ds</hi></abbr><expan>Lords</expan></choice> &amp; 4 by <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> <lb xml:id="l131"/>Commons <del type="cancelled">to <gap reason="illgblDel" extent="2" unit="chars"/></del>  &amp; to chose <del type="cancelled"><gap reason="illgblDel" extent="2" unit="chars"/></del> 3 more to succeed them &amp; empower every five <lb xml:id="l132"/>as any one <add place="supralinear" indicator="yes">of <choice><abbr>y<hi rend="superscript">m</hi></abbr><expan>them</expan></choice></add> shall drop to chose <del type="cancelled"><gap reason="illgblDel" extent="2" unit="chars"/></del> <del type="over"><gap reason="illgblDel" extent="1" unit="chars"/></del><add place="over" indicator="no">a</add> successor.</p>
